Introduction To prevail successfully in a tort action for negligence, the plaintiff must demonstrate, at a preponderance of the evidence, that the defendant was duty bound to the plaintiff; that the defendant breached the duty owed; that the breach altered the plaintiff's position, state, or status; and finally, that the change suffered by the plaintiff constitutes an injury. The plaintiff's failure to demonstrate any of the above-noted provisions will result in a decision in favor of the defendant. The provisions, therefore, are individually necessary and jointly sufficient for the plaintiff's case. (1)
